CLEMSON — On Friday, U.S. District Judge Charlotte Sweeney granted a nationwide, class-wide preliminary injunction requiring the NCAA to grant a fifth year of eligibility to all Division I athletes from the high school class of 2022, who have already exhausted their eligibility.

On Monday, Judge Sweeney’s decision will be reviewed. What’s at stake?

It is not her ruling on eligibility for the 2022 high school graduates. That ruling will hold true unless the NCAA wins its appeal, which was processed on Saturday. More on that in a minute.

The core of Sweeney’s ruling focuses heavily on forcing a blanket waiver for player eligibility, creating massive roster management impacts rather than striking down explicit cap numbers.

The NCAA contends that the sweeping order ignores the binding parameters of the House vs. NCAA antitrust settlement. The NCAA argues that one federal court cannot unilaterally undo or override roster constraints and caps enforced by another court order, creating an unmanageable contradiction for athletic departments.

If Sweeney’s ruling of roster constraints are lifted, like some expect it to be, then it will mean only a select few of the student-athletes that are being benefited an extra year, will actually be able to play this coming season.

As for the injunction itself, TCI was told its doubtful the NCAA’s appeal is up held anytime soon. Once source told us it likely will not go in front of a judge until mid-season in basketball. And they doubt anything will be done at the time, as the can will be kicked down the road.

TCI also learned if roster constraints are lifted, Clemson’s men basketball team can still sign one player. We were told, forward R.J. Godfrey, who entered the transfer portal in the spring, would be the Tigers’ primary target for that one roster spot.

However, it is unlikely Clemson can retain Godfrey due to the high-dollar amount his camp is asking for. If that is the case, Clemson will do what it can to bring back either Dillon Hunter or Butta Johnson.
